Bespoke Website Schedule

This Bespoke Website Schedule (the "Schedule") supplements the You Got A Site Terms of Service (the "Terms") and applies to a custom / bespoke website build engagement. It is incorporated into the Terms when you pay the deposit for the engagement. Capitalized terms not defined here have the meaning given in the Terms. If this Schedule conflicts with the Terms for a bespoke build, this Schedule controls for that engagement.

The scope of a bespoke build is what is written in your proposal or statement of work — nothing more, nothing less.

1. Fixed scope

The bespoke build covers the specific deliverables, pages, and features described in the written proposal or statement of work we agree with you (the "Scope"). Anything not stated in the Scope is out of scope and, if you request it, is additional work billed separately.

2. Deposit and balance

The price is payable in milestones: a deposit due before work begins and the remaining balance (or agreed milestone payments) due as stated in the proposal, with the final balance due on completion before final delivery and launch. We may pause work if a due payment is not made.

3. The deposit is non-refundable once work has begun

The deposit reserves our time and covers initial work. Once work on your project has begun, the deposit is non-refundable, and amounts for work already performed are non-refundable, except as required by law. Fees already incurred on your behalf are non-refundable.

4. Revisions and scope changes

The Scope includes the number of revision rounds stated in the proposal (and if none is stated, a reasonable number at our discretion). Additional revisions, new pages or features, or changes to agreed direction are out-of-scope changes that we may bill at our then-current rates and that may extend timelines. We will confirm added scope and cost before doing that work.

5. Timelines are estimates

Any dates or timelines are good-faith estimates, not guarantees. Timelines depend on your timely feedback, approvals, content, and payments; delays on your side extend them. We are not liable for delays caused by you or by events beyond our reasonable control.

6. Ownership transfers on final payment

You will own the final deliverable custom design and page content we create specifically for you upon our receipt of payment in full. Until final payment is received, all work product remains our property. This transfer excludes our pre-existing and general-purpose materials, templates, components, tools, and third-party or open-source materials, which we and their owners retain and which we license to you as needed to use your Site; and it excludes third-party assets (fonts, stock media, plugins) governed by their own licenses.

7. Your content and warranties

You represent and warrant that any content, logos, images, text, or materials you provide are yours or properly licensed, do not infringe any third-party right, and do not violate any law, and you will indemnify us for claims arising from them as provided in the Terms. All disclaimers and limitations of liability in the Terms apply to the bespoke build.
